If the document you have regarding the commission is clearly marked that the recipient for the commission is the Broker then what would be an idea, is to google a couple of companies that offer to challenge agreements on a no win no fee basis, there is quite a few.
Personally I would contact one and challenge it. You are challenging both the insurance issue, and the issues with the Commission, and anyone of these is enough to force Marlin to back down (hopefully). Both together puts you in a very strong position.
Whatever you do, if a settlement is reached, demand your Credit file be cleared of any diverse entries as part of anything offered.
When you dispute a debt, Credit and Finance companies should not be marking a Credit file with a default (but they do) it should read as disputed, Information Commissioners Office have confirmed this with me previously.
